Agreement to Terms

By accessing and using Chessalyz, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Use License

Permission is granted to temporarily access Chessalyz for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials
• use the materials for any commercial purpose or for any public display
• attempt to reverse engineer any software contained on Chessalyz
• remove any copyright or other proprietary notations from the materials

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

• You must be at least 13 years old to use this service
• You are responsible for maintaining the confidentiality of your account
• You agree to accept responsibility for all activities under your account
• You must notify us immediately of any unauthorized use of your account

Billing, Subscriptions & Refunds

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method the applicable fee for each billing period until you cancel.

All payments are final and non-refundable, except where a refund is required by applicable law. We do not provide refunds or credits for cancellations, partial billing periods, or unused features, except for account credits applied during eligible plan or billing-interval changes as described below.

• Cancellation: You may cancel at any time. Your subscription remains active and you retain access to paid features until the end of the billing period you have already paid for, after which your account returns to the Basic (free) plan.
• Downgrades: Downgrades to a lower plan take effect at the end of your current billing period. No refund is issued for the difference.
• Plan and billing-interval changes: When you switch plans or billing intervals, any unused value from your current period is applied as an account credit toward your next invoice, not returned as cash to your payment method.
• Usage-based features: Analysis credits and other consumable features are provided as part of your subscription and have no cash value once granted or consumed.

Chess Game Data

By connecting your Chess.com or Lichess accounts, or uploading PGN files, you grant us permission to:

• Access and analyze your game data for the purpose of providing our services
• Store your game data securely on our servers
• Generate insights and analytics based on your games
• Use aggregated, anonymized data for service improvement

Prohibited Uses

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To collect or track the personal information of others
• To spam, phish, pharm, pretext, spider, crawl, or scrape

Service Availability

We reserve the right to withdraw or amend our service, and any service or material we provide on the site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the site is unavailable at any time or for any period.

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Chessalyz and its licensors. The service is protected by copyright, trademark, and other laws.

Third-Party Services and No Affiliation

Chessalyz is not affiliated with, endorsed by, or connected to Chess.com, Lichess.org, or any other third-party chess platform in any official capacity.We are an independent service that uses public APIs provided by these platforms to help you analyze your games.

Any logos, trademarks, or references to third-party services (including but not limited to Chess.com and Lichess.org) are used solely for identification purposes to indicate that we can import games from these services. Such use does not imply endorsement, sponsorship, or affiliation with these services.

Logo Usage Disclaimer: The Chess.com and Lichess logos displayed on our platform are trademarks of their respective owners (Chess.com, Inc. and Lichess.org). We use these logos solely to identify the services from which users can import their games. This use is for informational purposes only and does not constitute endorsement, sponsorship, or any form of business relationship with these companies.

All trademarks, service marks, and trade names of third parties mentioned on our service are the property of their respective owners. We do not claim any rights to these trademarks and use them only to identify the services from which we can import your games.

By using our service to connect with third-party accounts, you acknowledge that you are subject to the terms of service and privacy policies of those third-party services, and that Chessalyz has no control over or responsibility for the content, policies, or practices of such third-party services.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Disclaimer

The information on this site is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms (express or implied, statutory or otherwise).

Limitation of Liability

In no event shall Chessalyz, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
